HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28524 OF 2018 ORDER:

The present writ petition came to be filed to declare the action of the 3rd respondent in issuing the notice bearing Rc.No.A/1219/2018 dated 03.08.2018 seeking to cancel Plot Nos.415 and 416, situated at Sy.No.61 of Padthampalli Village, Mancherial Mandal, Adilabad District, allotted under Rehabilitation and Resettlement (R & B) Policy of Government as per G.O.Ms.No.68 dated 08.04.2005 vide Patta No.A/1811/2015 dated 16.11.2015 and A/1811/2015 dated 16.11.2015, as illegal, arbitrary and violation of the principles of natural justice.

Heard Sri K.B. Ramanna Dora, learned counsel for the petitioner and the learned Government Pleader for Revenue. It is to be noticed that earlier the 4th respondent-Tahsildar issued a notice dated 7.7.2018, inviting explanation to the objections/complaints of villagers in allotment of house site patta Plot Nos.415 and 416, situated at Sy.No.61 of Padthampalli Village Shivaar, Hajipur Mandal and accordingly directed the petitioners to be present at 11.00 a.m on 19.07.2018 along with the documents, without fail. It is stated that pursuant to the said notice, petitioners herein submitted their explanation on 19.07.2018. Subsequently, another notice dated 3.8.2018 came to be issued to the petitioners by the 3rd respondentR.D.O, as he is the competent authority to deal with the subject matter, giving three days time to the petitioners to submit their explanations. Learned counsel for the petitioners submits that though the petitioners submitted their explanation on 19.07.2018, no action has been taken till date.

Having regard to the facts and circumstances of the case, the writ petition is disposed of giving liberty to the petitioners to submit their

explanation afresh to the notice dated 3.8.2018, issued by the 3rd respondent-R.D.O, who is the competent authority, within a period of three days from today i.e by 17.08.2018, in which event, the respondentauthorities shall consider and pass appropriate orders, in accordance with law, within a period of two weeks, thereafter. Status quo existing as on today, shall be maintained for a period of two weeks from today. With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
