479 of 2015 is filed to condone the delay of 4064 days in seeking to set aside the abatement caused due to the death of the second respondent. While the delay in the first application is more than 15 years, the delay in the second application is more than 11 years. The explanation given by the petitioner for this inordinate delay is woefully inadequate. In the affidavit, filed in support of the petition, it is stated that the office of the Government Pleader had requested them to ascertain the death of the second respondent; on receipt of the said communication, they had enquired from the village about the family members of the deceased; and it was then that they came to know that the second respondent had expired on 25.09.2003.

The affidavit is vague and does not contain even the basic particulars, including the date on which the appellants came to know of the death of respondents 1 and 2. We see no reason, therefore, to condone the inordinate and unexplained delay of 15 years and 11 years respectively. L.A.A.S.M.P.Nos.693 and 479 of 2015 are dismissed. Consequently, the Appeal Suit is dismissed as abated. The miscellaneous petitions pending, if any, shall also stand dismissed.
