HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8465 OF 2018 ORDER:

The petitioner is A3 among three accused in Crime No.35 of 2018 on the file of Thulluru Police Station, Guntur District. The crime is registered for the offences punishable under Sections 420, 468, 471, 409 r/w 34 IPC.

The petitioner is undisputedly not an agent or manager to attract the offence under Section 409 IPC, but for so far A2, if any. The petitioner-A3 is son of A1 and one year junior in the studies and friend of A2. So far as the other offences are concerned, none are punishable above seven years. The other accused stated were arrested and later enlarged on bail. However, still it is not a fit case to grant anticipatory bail to the petitioner, but for to say the police strictly follow Section 41-A Cr.P.C. So far as the application of penal provisions against the petitioner-A3 is concerned, none are punishable above seven years.
