Heard.
The grievance of the petitioners is that the 1st respondent is trying to arrest them in connection with Cr.No.112/12-13 on the file of the 1st respondent Police Station on the ground that the charge-sheet filed by the police is returned by the I Additional District and Sessions Judge-cum-Metropolitan Sessions Judge, L.B.Nagar, Ranga Reddy District. The petitioners state that having filed chargesheet, police have no power to arrest the petitioners and it is only the learned Sessions Judge, who can pass appropriate orders, after taking cognizance of the charge-sheet.
However, the instructions of the learned Government Pleader show that the learned Sessions Judge returned charge-sheet on 04-04-2015 with instructions to arrest the accused and file charge-sheet.
Since the charge-sheet is already filed before the learned Sessions Judge, the 1st respondent has to await orders of the learned Sessions Judge as to cognisance of the said charge-sheet and thereafter, take further action in the matter, if any, as per the directions of the learned Sessions Judge after cognisance is taken. With the above observation, the writ petition is disposed of. No order as to costs.
