THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11751 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1, 2, 3, 5, 6 and 7 in Crime No.168 of 2023 on the file of Noothankal Police Station, Suryapet District, registered for the offences under Sections 143, 147, 148, 324, 326 and 307 r/w. 149 of Indian Penal Code. 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Noothankal Police is that these petitioners and others formed into unlawful assembly on the evening of 27.08.2023 and attacked brother-in-law of the de-facto complainant, who received bleeding injuries. The reason for the assault was on account of dispute with respect to fencing in the land.

Learned Additional Public Prosecutor on instructions would submit that the injuries received by the de-facto complainant were grievous in nature, however he was not hospitalized.

It appears that there was a group fight and both groups were involved in attacking one another. Since specific overt acts are not attributed to the petitioner Nos.2 to 6 and also for the reason of injured being treated as out-patient, this Court deems it appropriate to grant the relief of regular bail to them, subject to following conditions:- i) The petitioner Nos.2 to 6/Accused Nos.2, 3, 5 to 7 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with two sureties, for a like sum each to the satisfaction of the Principal District and Sessions Judge at Suryapet.
ii) The petitioner Nos.2 to 6/Accused Nos.2, 3, 5 to 7 after release shall appear before the concerned Station House Officer at 10:00 a.m. every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required.
(iii) The petitioner Nos.2 to 6/Accused Nos.2, 3, 5 to 7 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is partly allowed. The prayer for bail to petitioner No.1/accused No.1 is rejected. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
