This writ petition is filed for the following relief; ".....

to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring that the petitioners are entitled to be treated the service rendered by them with effect from the date of their first appointment for the purpose of national increments and other benefits in terms of the instructions in the matter with all consequential benefits including counting of service for the purpose of Automatic Advancement Scales and also regular pay scales from the date of completion of training and further refunding the amounts deducted from the petitioners towards Contributory Pension Scheme till July, 2010 by holding the action of the respondents in not treating the service rendered by the petitioners from the date of first appointment inspite of fact that the petitioners were recruited through process of selection in DSC 2002 and also clear instructions to treat the period of training as apprenticeship period is as illegal, arbitrary, unjust discriminatory and violative of Articles 14, 16 and 21 of the Constitution of India and pass such other or orders as this Hon'ble Court may deem fit and proper" Learned counsel for the petitioners submits that the petitioners will make representation in respect of their grievance for refund of the amounts deducted from the petitioners towards Contributory Pension Scheme till July,2010.

Heard learned Government Pleader for Services.

Since the writ petition is filed by the petitioners without approaching the authorities, it is open for the petitioners to make representation before the competent authority and on such representation being filed by the petitioners the competent authority is directed to consider and dispose of the same in accordance with Rules and take action accordingly. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
