HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 4074 OF 2007 ORDER :

The petitioner is challenging the orders passed by the Labour Court-III, Hyderabad in I.D.No.17 of 2004, dated 9.9.2005 wherein the Labour Court-III while allowing I.D. preferred by the petitioner has set aside the orders of removal and ordered for reinstatement of the petitioner with continuity of service but without back wages and attendant benefits. 2.

The Counsel for the petitioner contended that the Labour Court-III ought to have awarded full back wages and attendant benefits. He further contended that appropriate orders may be passed in the Writ Petition directing the respondents to pay full back wages and attendant benefits. 3.

The Standing Counsel for the respondent-corporation submits that the Labour Court-III has rightly passed orders denying back wages and attendant benefits to the petitioner and there are no merits in the Writ Petition and the Writ Petition is liable to be dismissed.

This Court, having considered the submissions made by both the parties, is of the considered view that unless and until some grave irregularities or illegalities are pointed out by the petitioner this Court cannot interfere with the orders of the Labour Court-III and the Labour Court-III has rightly denied back wages and attendant benefits. There are no merits in the Writ Petition and the Writ Petition is accordingly dismissed. 5.
