HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.17394 of 2003 ORDER:

This writ petition is filed challenging the action of the Depot Manager, APSRTC who insisted for production of succession certificate for releasing the death benefits of deceased-Vinod Kumar, who worked as conductor in APSRTC.

2. As seen from the material, it appears that there is a rival claim for the death benefits, therefore the department insisted for succession certificate. Instead of obtaining succession certificate from a competent Court , petitioner moved this Court by way of writ.

3. Heard both sides.

4. During the course of hearing, advocate for petitioner seeks permission of this Court to withdraw the writ petition with liberty to file appropriate application before competent Court, to obtain succession certificate for getting the death benefits of late Vinod Kumar.

5. Permission as sought for is accorded.

6. Accordingly, this Writ Petition is dismissed as withdraw with liberty as prayed for. No costs. Miscellaneous Petitions pending in this writ petition, if any, shall stand closed.
