THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.21626 of 2014 ORDER:

This writ petition is filed for a direction to the respondents not to interfere with the petitioners services with regard to 'Mid-Day meals' scheme in Zilla Parishad High School and Mandal Parishad Upper Primary School (Main) situate in Parumanchala village, Jupadu Bangalow Mandal of Kurnool District.

The case of the petitioners and the submissions made on their behalf in this writ petition are as follows:

"Petitioners 1 and 2 are the members of Sri Lakshmi Narasimha Podupu Lakshmi Group and petitioners 3 and 4 are members of Sivasankar Podupu Lakshmi Group. The said groups are self-help groups. The 5th respondent - Tahsildar and Chairman of Mid-Day Meals Implementation Committee, Jupadu Bungalow Mandal, appointed petitioners 1 and 2 and petitioners 3 and 4 as implementing agencies for 'Mid-Day meals' scheme by his orders with effect from 01.04.2013. Since then the petitioners are discharging the said duties by cooking and serving food to the students. While so, the respondents 6 and 7 caused obstruction stating that their agencies are likely to be cancelled without following the procedure established by law and that therefore, the said proposed action is illegal as contrary to law." 3.

At the time of admission of this writ petition on 31.07.2014, this Court passed the following interim order in WPMP No.27125 of 2014. "Since the petitioners have been allowed to supply mid-day meals to the Zilla Parishad School and Mandal Parishad Upper Primary School (Main) situated in Parumanchala Village, Jupadu Bungalow Mandal, Kurnool District, they may be permitted to continue to do so, so long as no specific complaint about the poor quality of food being prepared and supplied by them is received. "

At the hearing, the learned counsel for the petitioners would submit that in view of the interim order, no further orders are required and that the writ petition may be disposed of making the interim order passed by this Court the final order.

There is no representation for the official respondents and no counter is filed.

Having regard to the submission of the learned counsel for the petitioners, the writ petition is disposed of in terms of the interim order passed by this Court on 31.07.2014. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
