THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Contempt Case No. 1208 of 2014 In W.P.No. 19881 of 2005 JUDGMENT:

This contempt case is filed for non-compliance of the Order of this Court in W.P.No.19881 of 2005, dated 14.08.2013. 2.

Heard Sri A.K.Jaya Prakash Rao, counsel for the petitioner and Smt. K.Udaya Sree, counsel for the Respondent. 3.

It has been contended by the learned for the petitioner that the Order passed in W.P.No.19881 of 2005, dated 14.08.2003 was not complied and the respondent is not paying the terminal benefits and other amounts to which the petitioner-workman is entitled to.

It has been brought to the notice of this Court by the counsel for the Respondent that the Order of this Court was complied with, vide proceedings dated 24.08.2014 whereby the total amount of Rs.90,843/ - was paid to the petitioner, by way of Demand Draft, towards the gratuity and other terminal benefits, and an additional amount of Rs.11,762/ - was also paid to the petitioner on 19.01.2017 by way of Bankers Cheque, dated 19.01.2017, towards the arrears of increment to which the petitioner was entitled. 5.

In view of the same, the Order of this Court has been complied with. However, the learned counsel for the petitioner contends that the respondent has not fully complied with the Order of this Court, and still the petitioner is entitled for some more amounts, and the respondent has erroneously calculated and

paid less amount to the petitioner. If that be so, the petitioner is at liberty to agitate his right to claim the unpaid amounts, if any, to which he is entitled, as per law.

In view of the above, as the respondent has complied with the Order of this Court, dated 14.08.2013 by paying the amounts to the petitioner, as stated above, the contempt case is closed. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
