M/S.Sri Venkateswara Fertilzers, v. The Commercial Tax Officer-I,
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.40635 of 2016 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This writ petition is filed to declare the action of the 1st respondent in blocking the facility of generating way bills and other statutory declarations by the petitioner, from the department web portal on account of arrears of tax, as illegal and arbitrary. Sri V.Bhaskar Reddy, learned counsel for the petitioner, states that the petitioner is in the process of preferring an appeal against the order of assessment.
It is wholly unnecessary for us to dwell on this aspect any further, as Sri S.Suri Babu, learned Special Standing Counsel for Commercial Taxes, states that the facility of generating way bills would be unblocked today, and the petitioner would be entitled to use the facility from tomorrow onwards.
Recording the submission of the learned Special Standing Counsel, the writ petition is closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) _____________________________ (A.SHANKAR NARAYANA, J) 23rd November 2016 JSU
