THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No. 19856 OF 2017 ORDER:

This writ petition is filed with the following prayer: "To issue a writ of mandamus or any other appropriate writ or writs, order or orders declaring the action of respondents more particularly respondent Nos.2 to 4 in not taking any stringent action against respondent No.5, as illegal, arbitrary and unconstitutional and consequently direct respondent Nos.2 to 4 to take appropriate and stringent action against respondent No.5 for illegal mining and unsafe blasting without obtaining Environmental Clearance as per the law laid down by the Hon'ble Supreme Court of India in Deepak Kumar v. The State of Haryana and others reported in ((2012) 4 SCC 629) with regard to the quarry lease area in Survey Nos.81 and 82 at Bogaram Village, Keesara Mandal, Ranga Reddy District, and which is abutting to the petitioner's lands in Survey No.

42/7/A, admeasuring Ac.3.07 guntas, Survey No.7/1 admeasuring Ac.7.20 guntas by contravening the provisions of law and the same is illegal, arbitrary, unjust, unconstitutional and against the principles of natural justice and pass such other and further order or orders as are deemed fit and proper in the circumstances of the case and in the interest of justice."

The case of the petitioner is that the fifth respondent, which is a mining industry, is conducting illegal mining activities in Survey Nos.81 and 82 of Bogaram Village, Keesara Mandal, Ranga Reddy District, which is abutting to his lands. Though the petitioner made a representation dated 17.04.2017 to respondents 1 to 4 to take action against respondent No.5, so far no action has been taken thereon. Hence, this writ petition.

Learned counsel for the petitioner confined his arguments only to the extent of directing the respondent authorities to consider the petitioner's representation dated 17.04.2017. After perusal of the record and hearing the arguments, without expressing any opinion on merits, this writ petition is disposed of with the following direction:

"Respondents to are directed to consider the representation of the petitioner dated 17.04.2017 and pass appropriate orders thereon in accordance with law." Consequently, Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
