HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28530 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 4th respondent-Tahsildar, in issuing the proceedings in Roc.A/271/2018 dated 31.7.2018, without issuing any notice to the petitioner, as illegal and arbitrary.
When the matter is taken up for hearing, learned counsel for the petitioner submits that the writ petition may be disposed of giving liberty to the petitioner to avail the remedy available under Sections 482 or 397 of Criminal Procedure Code, 1908, as the case may be. Having regard to the facts and circumstances of the case and since the petitioner is challenging the impugned proceedings under Sub Section 1 of Section 145 of Criminal Procedure Code, 1908, the writ petition is disposed of giving liberty to the petitioner to avail the remedy available under Sections 482 or 397 of Criminal Procedure Code, 1908, as the case may be.
With the above observations, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
