THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33990 of 2012 ORDER:

The grievance of the petitioner was that the Andhra Pradesh Open School Society, Hyderabad (for brevity 'the Society'), was not considering his representation dated 01.09.2012 for correcting the name of his father in the Secondary School Certificate issued to him. Therein, the petitioner's father's name was shown as Shaik Abdul Raheem. According to the petitioner, his father's name is actually Shaik Mohammed Abdul Raheem and a correction had to be made in the certificate to that effect.

It appears that the Director of the Society addressed letter dated 04.07.2012 to the AI Coordinator, Crescent Model English School, Riyasathnagar, Hyderabad, being the school, through which the petitioner's application and appearance for examinations was registered, calling upon it to submit certain documents for carrying out the correction sought by the petitioner. In the affidavit filed in support of the petition, the petitioner specifically stated that the said school furnished reply dated 31.07.2012 along with the corrected birth certificate issued by the Greater Hyderabad Municipal Corporation, but in spite of the same, the Society did not take steps to correct the petitioner's father's name in the certificate.

Despite passage of nearly three years since the institution of this writ petition, the Society has not chosen to file a counter-affidavit. However, this Court is of the opinion that the matter is amenable to final disposal without awaiting the response of the Society.

It shall be open to him to give a personal opportunity of hearing to the petitioner to make good any further deficiencies in this regard.

This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

The writ petition is disposed of with the above directions. Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
