THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17469 of 2016 ORDER:
This Writ Petition is filed complaining inaction of the 1st respondent-Project Director, DRDA-Velugu, Ongole, in acting on the complaint of the petitioner.
The brief averments in the writ petition are that the petitioner is a member of the Lalitha Podupu Group, Ommevaram, N.G.Padu Mandal, Prakasam District and in the said group there are two members by name Smt. Battula Sulochana w/o Sri B. Bapaiah, working as a Government Teacher and Smt. Pinninti Aruna W/o Sri P. Narasimha Rao, working as Bank Employee and they are family members of government employees and they have availed the benefits of the Lalitha Podupu Group. This aspect of the matter was brought to the notice of APM-N.G.Padu Mandal on 13.01.2016 who had promised to enquire into the same and take action. Though the time has been passed no action has been taken they once again addressed a letter dated 02.03.2016 to the 1st respondent reiterating the same. Learned counsel for the petitioner Mrs.
Shyamala appearing on behalf of the learned counsel Sri T. Vijay Kumar submits that a writ of mandamus may be issued against the respondents and to direct them to act on the complaint of the petitioner so as to prevent misutilisation of the government scheme by ineligible persons. Heard learned Government Pleader who submits that the writ petition may be disposed of with a direction to the respondents to consider the complaint of the petitioner and cause enquiry and pass orders.
In the circumstances, as it is the duty of the 1st respondent to
ensure that the schemes which are notified by the Government shall reach to the beneficiaries, who are eligible, and also to prevent ineligible persons from enjoying the same, as otherwise the eligible persons would be deprived of the notified schemes. In those circumstances, the writ petition is allowed with a direction to the respondent No.1 to take into consideration of the complaints of the petitioner dated 05.02.2016 and 02.03.2016 and take appropriate action after causing enquiry in accordance with law by issuing a notice to the persons who are alleged to have misutilised the government scheme (DRDA-Velugu).
Accordingly, the writ petition is allowed. There shall be no order as to costs. Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed. ________________________________ CHALLA KODANDA RAM, J Dated: 06.06.2016.
