THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12201 OF 2016 ORDER:

This Criminal Petition under Section 482 Cr.P.C. is filed by the petitioner seeking release of Tata Super Ace Mint Vehicle bearing registration No.TS 16UA 6394 in C.O.R.No.69 of 2016. Heard and perused the record.

Learned counsel for the petitioner submitted that if the vehicle is kept idle for a long period, there is every possibility of getting it damaged and that the petitioner is ready to produce the vehicle as and when required.

Learned Additional Public Prosecutor opposes the same and submits that the petitioner can approach the concerned authority for interim custody of the crime vehicle.

Considering the facts and circumstances of the case, the petitioner is directed to file an appropriate application before the concerned authority seeking release of his vehicle within ten (10) days from the date of receipt of a copy of this order, and on filing such application, the said authority shall consider and dispose of the same in accordance with law.

Pending miscellaneous applications, if any, shall stand closed in consequence.
