HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 28426 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 07.08.2018 in O.A.No. 749 of 2018, whereby, the Central Administrative Tribunal, Hyderabad Bench, Hyderabad, without granting interim relief sought for by the petitioner, directed the respondents to file reply by two weeks and adjourned the matter to 21.08.2018.

Heard the learned counsel for both the parties and with their consent, the writ petition is taken up for disposal at the admission stage itself.

The petitioner has been working in Debts Recovery Tribunal-I, Hyderabad for the last seven to ten years. Now, the petitioner's grievance is that by virtue of the recent Transfer Policy dated 08.06.2018, the 2nd respondent issued order dated 31.07.2018 transferring the petitioner from Debts Recovery Tribunal-I, Hyderabad to Debts Recovery Tribunal, Visakhapatnam.

The learned counsel for the petitioner submits that the Transfer Order dated 31.07.2018 has been challenged by some of the employees before the Central Administrative Tribunal,

SKK,J & AKS,J WP_28426_2018 Cuttack, and the Tribunal, vide Order Sheet dated 08.08.2018 in O.A.No. 410 of 2018, has granted interim stay. In view of the above, this Court, without commenting on the merits of the case, deems it appropriate to dispose of the writ petition by directing the Central Administrative Tribunal, Hyderabad to take decision on the interim relief sought for by the petitioner. Till then, the order dated 31.07.2018 passed by the 2nd respondent, shall remain stayed.

It is made clear that the interim stay granted by this Court shall remain in force till the Central Administrative Tribunal, Hyderabad passes appropriate orders on the interim relief sought for by the petitioner.

With the above observation, the writ petition is disposed of. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
