HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.38130 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ, order, or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in not arresting the accused person in FIR.No.290 of 2014 dated 01.07.2014 for the offences under Section 120-B, 384, 420, 406, 509, 506 of IPC and under Section 3(x) of the SC and ST Atrocities Act illegal, arbitrary and unjust and consequently direct the respondents No.3 and 4 to arrest the accused person and produced him before the competent Court."

Learned Government Pleader brought to the notice of this Court that pursuant to the registration of Crime No.290 of 2014 dated 01.07.2014, investigation was completed and a final report was filed on 30.12.2014 before the Judicial Magistrate of First Class, Malkajigiri, Medchel, referring the case as "lack of evidence". Since a final report has already filed, if the petitioner has got any objections/grievance, the remedy available to her is by way of a protest application as per the provisions of the Code of Criminal Procedure. Therefore, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, shall also stand dismissed. _____________________ P. KESHAVA RAO, J Date: 10.01.2020.
