This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.383 of 2022 pending on the file of Station House Officer, Jubilee Hills Police Station, Hyderabad registered for the offences punishable under Sections 376(2), 417, 420 and 313 of Indian Penal Code and Section 3(2)(V) of SCs and STs (POA) Amendment Act, 2015. 2.

Heard learned counsel for the petitioner-Accused and learned Additional Public Prosecutor for the respondent-State. Perused the record.

According to the de facto complainant she was acquainted with this petitioner since seven (07) years and they both worked as actors in films. Two months after their acquaintance, the petitioner proposed his love for her and they were constantly in touch on phone. The de facto complainant was also taken to several places throughout the period of seven years which include hotels, resorts,

his house, native place etc., and they had sexual intercourse. When she was pregnant, some tablets were given by this petitioner but she refused. However, she got aborted two days later when she took medicine for weakness. The said medicine was given by this petitioner stating that it was for strength however, it resulted in an abortion. Thereafter, the de facto complainant came to know that this petitioner was married and having six years old daughter. The petitioner further delayed the promise of marrying the de facto complainant, she lodged the present complaint. 4.

As seen from the remand report, the complainant and the accused had consensual sex over a period of seven years and for the reason of refusal to marry the de facto complainant, she lodged the present complaint. Since the petitioner is in jail from 13.10.2022 and major part of the investigation is complete, the prayer for regular bail can be granted.

Accordingly, the Criminal Petition is allowed and the petitioner-Accused is granted bail subject to the following conditions:

i) The petitioner-Accused is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, to the satisfaction of XVII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

ii) After release on bail, the petitioner-Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner-Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
