HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6321 of 2003 ORDER :

This writ petition is filed seeking to declare the action of respondent in not awarding the scale of pay of Rs.1,640-2,900 to the petitioner with effect from the date of his appointment on par with the similarly placed employees in the respondent-Institute, as illegal and arbitrary.

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and this Court is of the view that the writ petition can be disposed of directing the petitioner to submit a detailed representation to the respondent within one week from the date of receipt of a copy of this order, and upon such representation being received, the respondent shall pass appropriate orders in accordance with law, within four weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.
