THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9115 of 2016 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.182 of 2011 on the file of the II Additional Judicial First Class Magistrate, Khammam, registered for the offences punishable under section 420 r/w.34 IPC.

Heard the learned counsel appearing for the petitioner/A4 and the learned Additional Public Prosecutor, representing the State. The main grievance of the petitioner is that he is shown as A4 whereas non-petitioners are A2 and A3 in the above case. The two non-petitioners/A2 & A3 who are said to be the native of Uttar Pradesh are absconding for years together and the Court below is not taking appropriate steps in the matter.

In view of the above, the Criminal Petition is disposed of, directing the Court below to consider the feasibility of separating the case against the non-petitioners/A2 & A3, who are said to be absconding and proceed with the trial against the petitioner/A4 is concerned and dispose of the same, as expeditiously as possible. Pending miscellaneous applications, if any, shall stand closed in consequence.
