THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1117 OF 2016 ORDER:

This Criminal Revision Case is filed by the petitioner challenging the order of XV Additional Chief Metropolitan Magistrate-cum-Special Court for Trial Video Piracy Cases, Hyderabad in dismissing Crl.M.P.No.269 of 2015 in Crime No.216 of 2015 filed under Section 451 Cr.P.C. seeking return of the original passport of the petitioner which was recovered and seized by the immigration authorities and deposited with the Court.

Learned counsel for the petitioner submits that it is necessary for the petitioner to travel to Dubai as his mother, who is employed in Dubai is suffering with severe ailments and that the petitioner is ready to comply with the conditions that may be imposed by this Court for return of the passport. Having regard to the facts and circumstances of the case, the trial Court is directed to return the original passport to the petitioner on condition of petitioner executing a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum. With the above directions, the revision is disposed of. Consequently, pending miscellaneous petitions shall stand closed.
