THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8493 of 2018 ORDER :

Though notice served to the de facto complainant/2nd respondent, no representation on his behalf.

Learned counsel for the petitioner submitted that the petitioner may be permitted to withdraw the criminal petition. The petitioner is permitted to withdraw the criminal petition with a liberty to urge all the defences including non application of the offence under Section 307 IPC and no such alleged occurrence even taken place from the CCTTV footage nearby coverage in entirety, to place before the trial Court as part of material to consider at the stage of hearing before charges with entire prosecution material also including as to the at the crime stage, the offence under Section 509 IPC was quashed and charge sheet in ignorance of that even was filed and taken cognizance to urge with reference to the same. So far as NBW stated issued from the petitioner/accused already on bail on presence, the warrant can be recalled by virtue of this order.
