THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.18073 OF 2010 ORDER:
The relief sought for in this Writ Petition is to declare the construction of a function hall, raised by the fourth respondent without permission, as arbitrary, illegal and contrary to law; and to direct the official respondents to demolish the said function hall. Sri Sampath Prabhakar Reddy, learned Standing Counsel for the GHMC, on instructions, would submit that a notice under Section 452 of the GHMC Act ("the Act" for brevity) was issued on 27.03.2010; a final notice under Section 636 of the Act was issued on 03.09.2010; and the said building was demolished on 18.09.2010.
The building/function hall itself has been demolished more than seven (7) years ago. It is evident, therefore, that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court.
The Writ Petition is, therefore, dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
