HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 15201 of 2015 Order:

The petitioner was appointed as a Clerk in the office of the fourth respondent on 08.09.2012. He was sent for training from 03.10.2013 to 19.02.2014. While so, it was alleged that the petitioner used unparliamentary language against the fourth respondent and a show cause notice was issued in that connection. The petitioner submitted his explanation on 12.04.2015 denying the allegation. However, a General Body Meeting was called for by the fourth respondent on 15.04.2015 and unanimous decision was taken to place the petitioner under suspension. Accordingly, proceedings were issued on 15.04.2015 suspending the petitioner and calling for explanation from the petitioner. The petitioner submitted his explanation on 05.05.2015. When the enquiry was not completed, the present Writ Petition is filed.

2. After four adjournments, learned counsel for the fourth respondent submitted that an Enquiry Officer is appointed and the enquiry is under process. But, the learned counsel for the petitioner submits that no subsistence allowance is paid to the petitioner. Learned counsel for the fourth respondent states that the petitioner is only a daily wage employee and he is not entitled for subsistence allowance.

3. In the circumstances, this Writ Petition is disposed of directing the fourth respondent to complete the enquiry, in view of submission of explanation by the petitioner, as expeditiously as possible, but not later than four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
