THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.7891 OF 2015 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the Writ Petition is as under: " ....to issue a Writ, Order or Direction more particularly one in the nature of Mandamus declaring the acts of respondent No.3 in harassing the Petitioner's family members and intimidating them for securing the presence of the Petitioner without following due process of law as being illegal, arbitrary and unconstitutional and direct the respondent No.3 and his personnel not to harass the petitioner and his family members in any manner."

The specific grievance of the petitioner is that respondent No.3 is harassing the family members of the petitioner and intimidating them for securing his presence without following due process of law.

Learned GP appearing for respondent Nos. 1 to 3 placed on record, the written instructions dated 9.4.2015 issued by the SubInspector of Police, Vikarabad Police Station, RangaReddy district. A perusal of the said proceedings would indicate that the petitioner has been arrayed as accused for the offence under Sections 324 and 506 read with 34 IPC in Crime No. 28 of 2015. During the course of investigation, respondent No.3 visited the scene of offence and recorded the statements of LWs 2 to 5. Except conducting an investigation, respondent No.3 never threatened the family members of the petitioner and never went to the house of the petitioner. It is also mentioned in the said written instructions that the whereabouts of the petitioner are not known and the petitioner

was absconding as on the date of issuance of the written instructions.

In that view of the matter, there is no truth in the allegation made by the petitioner and the Writ Petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
