HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14116 OF 2017 ORDER:

This writ petition is filed declaring the action of the 3rd respondent in not considering the representation of the petitioner dated 06.04.2017 seeking not to entertain any correction and registration of Plots belonging to Kurnool District Government Class IV Employees Cooperative House Building Society Limited, P.No.115, Kurnool in favour of 3rd party/members till disposal of E.O.P.No.1/2016 on the file of Principal District Judge, Kurnool, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Admittedly, petitioner already filed E.O.P.No.1/2016 under Section 61(3) of A.P. Co-operative Societies Act, 1964 in respect of the dispute between the petitioner and the 3rd respondent Society. Pending the same, petitioner preferred the present writ petition. Once the petitioner has availed alternate remedy by way of O.P, again he cannot file the writ petition, which is rightly pointed by the Assistant Government Pleader for Revenue.

In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. However, it is open for the petitioner to avail alternate remedy available to him under law. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 20.04.2017 dv
