This Writ Petition is filed seeking a direction to the respondents 1 to 4 to take action against the fifth respondent for filling up of his fish pond with salt water and causing loss to the petitioners land in Survey No.450/3 of Vissakoderu Sivaru, Vankayalapalem, Palakoderu Mandal, West Godavari district.
Learned Government Pleader, on the basis of written instructions received from the Fisheries Development Officer, Bhimavaram, dated 02.08.2017, submits that the fifth respondent obtained final permission on 05.12.2016 and the petitioners approached "Meekosam" and on the representation of the petitioners, the fish pond of the fifth respondent was inspected and he was directed to comply with the terms and conditions of the final permission and the bore was seized. It is noticed that the fifth respondent filled up the pond with fresh water only from the local drain for doing fresh water aquaculture. The fifth respondent dug the fish pond in accordance with the norms and guidelines stipulated in the GOs, since he is maintaining three (3) meters distance between the petitioners land and his land.
In view of the said instructions, no clause of action survives in the present Writ Petition and the Writ Petition is, accordingly, dismissed. However, it is open to the petitioners to bring it to the notice of the authorities, if the fifth respondent violates any terms and conditions of the final permission granted to him. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
