HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 4060 of 2009 Order:

This Writ Petition was filed challenging the inaction on the part of the respondents 2 to 4 in taking action pursuant to the complaint dated 22.08.2008 given by the petitioner.

A counter affidavit is filed stating that after receipt of the petition dated 22.08.2008 from the petitioner on 25.08.2008, a reply was promptly given to him to his address given in the petition on 28.08.2008 informing him to approach the competent court of law for redressal of his grievance and the Registering Officer is not empowered to cancel the registered document.

Today, when the case is called, none appeared for the petitioner. However, learned counsel appearing for the respondents 5 and 6 submits that the sole petitioner died.

In the circumstances, nothing survives for consideration in the present Writ Petition and the Writ Petition is, accordingly, dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
