Heard learned counsel for the petitioner and learned counsel for the Caveator/respondent No.5.

2. It is evident that there are two second appeals pending before this Court arising out of civil litigation between the petitioner and the fifth respondent viz. S.A.No.1016 of 2012 filed by the petitioner and another SA(SR).No.18916 of 2014 filed by the fifth respondent herein. It appears that the civil proceedings, before the Courts below, adjudicated the rights claimed by the petitioner herein and the same was negatived. Unless the petitioner obtains appropriate order in the said second appeal, filed by him, the relief claimed in the writ petition cannot be granted. Hence, the impugned order, which is stated to have been passed against the father of the petitioner, cannot be questioned by the petitioner. However, the petitioner is at liberty to seek appropriate relief in the civil proceedings pending before this Court.

The writ petition is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V. AFZULPURKAR, J September 21, 2015 DSK
