THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39872 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in not considering the application dated 16.09.2016 and proposing to constitute a Trust Board to Sri Vijaya Ganapathi Saibaba Devastanam, Srinagar, Karimnagar Town and District, as illegal and arbitrary, and contrary to the proceedings Rc.No.12/47968/2007, dated 16.09.2008, issued by the second respondent, and consequently to direct the respondents no nominate the petitioner as Chairman to the subject temple. Heard and perused the material.

Learned counsel for the petitioner submits that challenging the proceedings in Rc.No.12/47968/2007, dated 16.09.2008, the petitioner earlier filed a writ petition and subsequently, the same was dismissed as withdrawn. However, till date, the second respondent has not passed any orders implementing the said proceedings. The representation, dated 16.09.2016, made by the petitioner is pending before the second respondent, is not disposed of till date. Hence, he prays this Court to direct the second respondent to dispose of the representation of the petitioner. Considering the facts and circumstances of the case, the second respondent is directed to dispose of the representation, dated 16.09.2016, as early as possible, preferably within a period of three months from the date of receipt of copy of this order.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 18.11.2016 pln
