THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.17390 OF 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed to quash the order passed in Crl.M.P.No.6135 of 2011 in C.C. No.853 of 2010 pending on the file of Additional Judicial First Class Magistrate, Narsapur, West Godavari District, on various grounds.

The petitioner filed an application under Sections 437 and 167 of Cr.P.C. alleging that he filed an application under Section 438 of Cr.P.C. for pre-arrest bail in Crl.M.P.No.1252 of 2011 in Cr.No.226 of 2008 of Narsapur Town Police Station, while allowing the application, he was directed to surrender himself before the Additional Judicial Magistrate of I Class, Narsapur, within 15 days from the date of order who shall release him on bail on his execution of bond Rs.10,000/- (Rupees ten thousand only) with two solvent sureties for the likesum to the satisfaction of the learned Magistrate. In pursuance of the direction, the learned Magistrate accepted the sureties furnished by the petitioner, but adjourned the petition on various dates and issued N.B.W.

Despite a direction issued by the Sessions Judge in Crl.M.P. No.1252 of 2011 granting pre-arrest bail, keeping Crl.M.P. No.6135 of 2011 pending for years together is nothing but causing inconvenience to the parties.

CRLP_17390_2016 MSM, J - 2 - Therefore, the Judicial Magistrate of First Class, at Narsapur is directed to dispose of the petition within 15 days from the date of receipt of a copy of this order, in accordance with law.

With the above direction, the criminal petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
