HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.17769 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents 1 to 3 and their subordinates in interfering in the issue which is civil in nature at the instance of fourth respondent which is illegal, arbitrary and violative of Article 21 of Constitution of India and consequently direct them not to interfere with the affairs of the petitioner's family with respect to the properties which are civil in nature of issue related to the properties belonging to the petitioner's family." The 3rd respondent filed his counter affidavit denying the averments made in the affidavit filed in support of the writ petition and contended inter alia that on 20.06.

2014, the Station House Officer, Langer House Police Station, Hyderabad, received the complaint of the petitioner through the Deputy Commissioner of Police, West Zone, Hyderabad, for necessary action. In the complaint the petitioner has stated that she needs police protection from her sister-in-law i.e., the 4th respondent herein and others, as the said persons harassed and threatened her with dire consequences. Based on the said endorsement, the Station House Officer, Langer House, has entered the same in the general diary. During the course of enquiry, it was revealed that there was a civil dispute between the petitioner and the 4th respondent with regard to properties.

petitioner to approach the competent Court of law for redressal. However, the contention of the petitioner that at the influence of the 4th respondent, the respondent police have threatened her to vacate the house bearing No.9-4-86/10, Salarjung Colony, Hyderabad, is totally incorrect, baseless and far from truth. It is also mentioned that with regard to the subject property a suit in O.S.No.40 of 2014 is pending on the file of the civil Court, Hyderabad, for which the respondent police are nothing to do with the same. The respondent police nor their subordinates have never harassed and threatened the petitioner with life and liberty, particularly, with regard to the civil dispute relating to the land between the petitioner and the family members of the 4th respondent at any point of time.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, shall also stand dismissed.
