HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 28522 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 and 3 in not issuing certified copies of the registered document bearing No.10548/ 2003 and document No.10549/ 2003, dated 30.08.2003, registered at respondent No.3 office as illegal, arbitrary and violative of principles of natural justice.

2) The petitioner claims to be the actual owner and possessor of the plot No.89 an extent of 200 square yards and plot No.23 an extent of 150 square yards in Sy.No.104, situated at Almasguda Village, Balapur Mandal, Ranga Reddy District, having purchased the same through registered sale deeds bearing document Nos.10548 and 10549 of 2003 from one Veerarjun Reddy and Md.Jhagir. It is stated that the above plots were purchased by his father by name Borra Manmohan Reddy in his name. It is stated that the petitioner misplaced the original registered sale deeds elsewhere as such he is put to lot of inconvenience. According to him, though he has approached the respondents 1 and 2 several times for issuance of certified copies, but the authorities are refusing to furnish certified copies of the same. 3) The learned Government Pleader for Revenue (TG), on instructions, states that there is a procedure prescribed for issuing

a certified copy when the Xerox copy of the document is not available. According to him, the petitioner has to give a paper publication indicating the misplacement/ loss of the document, then get a crime registered and make a suitable application before the authorities, pursuant to which it will be considered in accordance with law. The said fact is not seriously disputed by the learned counsel for the petitioner, but his only grievance is that the petitioner is not having even the Xerox copy of the said documents.

4) Be that as it may the petitioner shall first give a report before the concerned police and thereafter a paper publication intimating the loss of registered sale deeds in respect of lands in issue and thereafter make a suitable application in terms of the procedure before the authorities concerned, in which event the authorities shall deal with the same in accordance with law. 5) Accordingly, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 21.08.2018 gkv
