THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9604 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.10 in Crime No.5 of 2021 pending on the file of Station House Officer, CID Police Station, Hyderabad registered for the offences punishable under Sections 406, 409, 420, 468, 471 read with 120-B of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner/Accused No.10 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that while he was working as Branch Manager of State Bank of India, he colluded with Accused Nos.1 to 9 and granted Mudra loans to Accused Nos.1 to 9 though they are not entitled to the said loan. The said loans were granted on the basis of fake documents that were furnished by Accused Nos.1 to 9 which is in the knowledge of this petitioner.

The petitioner was arrested on 22.09.2022. The reading of the remand report would reveal that all the relevant witnesses were examined and the relevant documents were in possession of the Investigating Officer. Since the entire evidence is based on documentary evidence and the documents being in possession of the Police, the petitioner can be granted the relief of regular bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.10 is granted bail subject to the following conditions:

i) The petitioner/Accused No.10 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum to the satisfaction of I Additional Judicial First Class Magistrate, Warangal.

ii) After release on bail, the petitioner/Accused No.10 shall appear before the concerned police station on every Monday between 10.00 A.M and 01.00 P.M, for a period of six (06) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner/Accused No.10 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 09.11.2022 rev/tu
