THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No. 227 of 2014 JUDGMENT: (per the Hon'ble Sri Justice Dilip B.Bhosale) Heard learned counsel for the parties.
This writ appeal is against the part of order, dated 13.02.2014, passed by learned Single Judge in W.P.M.P.No.4985 of 2014 in W.P.No.4039 of 2004, whereby the appellant has been directed to deposit 50% of back wages, allowing respondent No.3 to withdraw the same without furnishing any security.
Learned counsel for the appellant submits that the appellant would be satisfied if respondent No.3 is allowed to withdraw 25% of the back wages i.e. 50% of the amount deposited by them, and remaining 25% by furnishing security subject to outcome of the writ petition or an order passed on an application, if any, filed by the parties after hearing both the sides.
Learned counsel appearing for respondent No.3, on instructions from his client who is present in the Court, submits that respondent No.3 is prepared to withdraw the 25% of the
amount unconditionally and remaining 25% on furnishing security, as aforementioned, subject to the outcome of writ petition or an order passed on an application, if any, filed by the parties. His submission is recorded and accepted. In view thereof, this writ appeal is disposed of accepting the submissions made on behalf of the parties. No costs. Consequently, miscellaneous petitions, if any, also stand disposed of.
