THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 38950 of 2014 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for the following relief: "... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not disposing of the petitioner representation dt.01.11.

2014 for appointment of Special Officer to deal with the complaint and spending of amount towards welfare of the region of Choutupal Mandal, Nalgonda District by involving local Gram Panchayats with approval of the Grama Sabhas is illegal, arbitrary, in violation of principles of natural justice and in violation of Article 16, 19 and 21 of the Constitution of India and consequently direct the respondent No.1 to take stringent action against the erred respondents 2 to 5 thereby curtail the disastrous effect since 2 decades in the Choutuppal Mandal, Nalgonda District." Ignoring all the details we took note of the substance of the prayer and we find that the petitioner wants that monitoring exercise shall be done by an independent person in the matter of discharging of corporate social responsibility. We have checked up the law.

There is no provision for appointment of such Special Officer. The writ petition is accordingly dismissed. However, liberty is given to the petitioner to file a fresh writ petition in accordance with law seeking for an appropriate relief, which is permissible under the law.
