THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP 25120 OF 2016 ORDER:

The case of the petitioners is that they are small farmers and they are in possession of small extents of lands in Sy.No.378-7 to an extent of Ac.0-27 cents of Kalyandurg Village and Mandal, Ananthapur District, since 40 years and also paying taxes to the Municipality, but the 2nd respondent without passing any orders on the earlier directions issued by this Court passed in WP No.1489 of 1996 and 1490 of 1996, issued fresh notice on 26-02-2016 for removal of encroachments and for eviction and they have also filed detailed reply on 02-03-2016 for consideration of their case for assignment of the land in their favour, as per the rules governing the field.

2. The grievance of the petitioners is that without passing any orders on the reply filed by them, pursuant to the notice dated 26-02-2016, the 2nd respondent is trying to dispossess them by demolishing the structures on the land. Hence, this writ petition.

3. Heard the learned counsel for the petitioners and the Learned Assistant Government Pleader for Revenue.

4. Inasmuch as the petitioners stated to have already submitted detailed reply to the notice dated 26-06-2016 issued

by the 2nd respondent-Tahsildar, Kalyandurg, Ananthapur District, the writ petition is disposed of directing the 2nd respondent to consider the reply dated 02-03-2016 submitted by the petitioners and pass appropriate orders thereon, in accordance with law, expeditiously. Till then, the petitioners shall not be evicted from the land in question. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. No order as to costs.
