THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.12901 of 2025 ORDER:

The present Criminal Petition is filed praying this Court to grant pre arrest bail to the petitioners who are arrayed as accused Nos.2, 5 and 6 in Crime No.437 of 2025 before the Karimnagar - I Town Police Station, registered for the offences punishable under Sections 61, 338, 318(4), 336(3), 340, 329(3), 351(2) read with 3(5) of BNS.

The brief facts of the case are that the complainant, Bachu Raju, alleged that the original owner, Sugun Rajeshwar Ado, sold land in Sy.No.449, Plot No.5, to Shanti Swaroop in 1990. The land was subsequently sold to Vemula Kamala, who then sold portions to Gudise Vijaya Laxmi and Gudise Malleshwari. In 2009, both sold their portions to the complainant through a GPA, with Accused No.1 signing as a witness. The complainant later registered the land in his wife's name. However, Accused No.1, Nuguri Sharadha, claimed rights to the land and filed an application before the District Collector, which was dismissed. Despite this, Accused No.1

and others allegedly executed fraudulent sale deeds and threatened the complainant with dire consequences. 3.

Heard Sri Mirza Azmath Ali Baig, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for the petitioners submitted that there are no specific allegations against petitioners A.3, A.5, and A.6, and they have been falsely implicated in the case. He further submitted that the transactions alleged are baseless, and the petitioners have no connection to the offense. He contended that the case is civil in nature, and the complainant has filed the complaint to harass the petitioners and gain an advantage. While advocating that the petitioners are permanent residents of Karimnagar, have fixed abodes, and are willing to cooperate with the investigation, and averring that they have also filed documents showing that they are the owners and possessors of the land in question, and there are ongoing civil suits between the parties, he prayed this Court to grant anticipatory bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the allegations against the petitioners are of serious nature which require investigation. Therefore, prayed the Court to dismiss the criminal petition. 6.

Having regard to rival submissions made and on going through the material placed on record, it is noted that the petitioners purchased the property subsequently from accused No.1 and there are civil suits pending between the parties. Therefore, considering the facts and circumstances of this case in detail, this Court deems it fit to grant pre-arrest bail to petitioners, subject to compliance of the following conditions: i.

The petitioners shall surrender before the Station House Officer, Karimnagar - I Town Police Station, within two weeks from today, and on such surrender, the said Station House Officer shall release petitioners on bail, on their executing a personal bond for Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
