THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11783 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in Crime No.309 of 2023, on the file of Mangalhat Police Station, Hyderabad, registered for the offence punishable under Section 8(c) r/w. 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Mangalhat Police is that on 09.10.2023 on receiving information, they have conducted raid in a house wherein accused Nos.2 and 3 were found in possession of 2 kgs. of ganja and cash of Rs.3,07,500/-. The Police apprehended accused Nos.2 and 3 and remanded to judicial custody. Having recorded the confession of accused

Nos.2 and 3, it is stated that the involvement of this petitioner and several others came into light. 4.

Learned counsel appearing for the petitioner would submit that petitioner has not committed any offence and nothing was seized from his possession. He further submits that he has been falsely implicated on the confession of other accused and sought for relief of bail.

Since the only basis for implication of this petitioner is confession, this Court is inclined to grant the relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of the XVI Additional Chief Metropolitan Magistrate, at Hyderabad.

ii) The petitioner/Accused No.4 after release shall appear before the concerned Station House Officer on every Monday for a period of eight (08) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
