THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11772 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.105 of 2023 on the file of Mokilla Police Station, Narsingi, Cyberabad, registered for the offences under Sections 365, 368, 327 and 120B r/w. 149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of Narsingi Police is that the nephew of the victim lodged a complaint stating that his uncle was kidnapped and after kidnapping, ransom was also paid. During the course of investigation, other accused were arrested. It was confessed that this petitioner who was working as ACP was also involved. The involvement according to the confession was that accused/A-3 approached this petitioner and this petitioner provided a tracker which was fixed to the vehicle of the victim. However, since the tracker which was provided by this petitioner
did not work, A-3 purchased another tracker and the victim was abducted.

Since the remand report does not reflect that this petitioner was actively involved in the subsequent abduction of the victim, the relief of anticipatory bail can be granted, subject to following conditions:-
1) The petitioner/Accused is directed to surrender before the Station House Officer, Mokilla Police Station, Narsingi, Cyberabad, on or before 11.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused shall appear before the concerned Police at 10:00 a.m. on every Monday and Wednesday for a period of four weeks for the purpose of investigation and thereafter, as and when required.
3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
