HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28139 OF 2011 ORDER:

When the matter is taken up for hearing, learned counsel, appearing on behalf of the petitioners, would submit that the issue raised in this writ petition is squarely covered by the judgment rendered, earlier, by this Hon'ble Court, in Writ Petition No.19277 of 1999, dated 13.09.2000.

Learned counsel for the petitioners submits that the petitioners were initially appointed as Junior Lecturers in the 3rd respondent - college during the year 1988. However, regular pay scales were extended to the petitioners and, consequent upon issuance of the G.O.Ms. No.328, dated 15.01.1997, their services were regularized in aided posts with effect from 06.04.1998 and 13.04.1998 respectively.

The grievance of the petitioners is that, in respect of certain individuals, the State Government has regularized the services of the similarly situated Junior Lecturers with retrospective effect i.e. from 01.04.1994, but the State Government has been discriminating the petitioners for regularization of their services with prospective effect. They contend that they are also entitled for regularization of their services with retrospective effect i.e. from 01.04.1994.

Since the issue has been adjudicated in the above said writ petition, learned Government Pleader for Higher Education, appearing on behalf of the respondents, also not disputed about the said facts and contends that appropriate orders may be passed directing the respondents to regularize the services of the petitioners with effect from 01.04.1994.

This Court, having considered the rival submissions made by the parties, is of the considered view that this writ petition can be disposed of with a direction to the respondents to regularize the services of the petitioners with effect from 01.04.1994, with all consequential benefits. 6.

With the above direction, the writ petition is disposed of. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
