THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9630 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.3 & 4 in the event of his arrest in Crime No.96 of 2022 on the file of Station House Officer, Mamada Police Station, Nirmal District, registered for the offence punishable under Section 306 read with 34 of Indian Penal Code. 2.
Heard learned counsel for petitioners/Accused Nos.3 & 4 and learned Additional Public Prosecutor for respondent-State. Perused the record.

The allegation against this petitioner is that the deceased and his wife went to their in laws house to celebrate Dussehra festival while coming back home, the deceased could not control his bike for which reason, he fell and received injuries. The parents and close relatives of the wife of the deceased went to the hospital and beat the deceased saying that he was the cause for the accident resulting in injuries to his wife. unable to bear insult of being beaten up by in
laws, he committed suicide on 09.10.2022. The present petitioners are the relatives of the wife of the deceased. 4.
It appears to be a case of altercation due to differences regarding the accident that took place. For the said reasons, the petitioners who are relatives of both the deceased and his wife can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.3 & 4 shall be enlarged on bail in the event of his arrest subject to the following conditions: i) The petitioners/Accused Nos.3 & 4 are directed to surrender before the Station House Officer, Mamada Police Station, Nirmal District within ten (10) days from today, and on such surrender, they shall be enlarged on bail on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each, to its satisfaction.
ii) On such release, the petitioners/Accused Nos.3 & 4 shall appear before the concerned Station House Officer on every Monday at 10.00 AM for a period of six (06) weeks and thereafter as and when required for the purpose of investigation. iii) The petitioners/Accused Nos.3 & 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
