Rayala Ademma v. The State Of Telangana,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21904 OF 2016 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Home. With the consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.
Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary. 2 . The present writ petition came to be filed with the following prayer:
"to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd Respondent in interfering with the rights of the petitioners at the instance of the respondents 3 and 4 herein yielding to the pressures brought out by them through their political identities by not permitting the 2nd petitioner to conduct agricultural operations in an extent of Acs.2.12 Gts., in Sy.No.90 of Chimiryala Village and not taking any action in pursuance to the complaint lodged by the 1st petitioner against respondents 3 and 4 herein as long back as on 12.06.2016 and trying to settle the civil dispute even though he does not have any authority, as being illegal, arbitrary and is in violation of principles of natural justice and established judicial precedents, and pass such other order or orders as are deemed fit and proper."
3. The grievance of the petitioners appears to be that the 2nd respondent-police at the instance of unofficial respondents is illegally and intentionally calling them to the police station; preventing them from carrying agricultural operations in the subject land and pressurizing to settle the disputes pending between them and the unofficial respondents, in spite of lodging a
report before the police.
4. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and if the petitioners are to be summoned to the police station, respondents will follow the due process of law.
5. Having regard to the above, the Writ Petition is disposed of directing the respondents-police to be mindful of the limits of their jurisdiction in criminal law and not to interfere with the agricultural operations of the petitioners in the land in dispute. Needless to mention that the respondents shall follow the due process of law while summoning the petitioners to the police station. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
