HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE DR JUSTICE SHAMEEM AKTHER W.P. No. 1563 of 2007 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the interim order dated 26.09.2006 passed by the Tribunal in O.A.No. 6117 of 2006 whereby the petitioners herein were directed to continue the respondent - applicant in service up to 19.03.2007 pending further orders.

We note, the Tribunal, vide order dated 10.10.2006, made the interim order dated 26.09.2006 absolute, however the petitioners have not challenged the subsequent order dated 10.10.2006.

Inasmuch as O.A.No. 6117 of 2006 is stated to be still pending adjudication, we find no ground to interfere with the impugned order.

Accordingly, the writ petition is dismissed. However, liberty is granted to the petitioners to approach appropriate forum i.e. the Tribunal where O.A.No. 6117 of 2006 is pending. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
