THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41081 of 2015 ORDER:
The grievance of the petitioner was that the Commissioner of Prohibition and Excise, State of Telangana, the second respondent, did not consider his representation dated 04.11.2015, whereby he sought permission to shift his shop from Shop No.13 at Mamnoor Village, Hanamkonda Mandal, which falls in Division Nos.5 and 6 of Greater Warangal Municipal Corporation, Warangal, to Timmapur Village, which, according to him, also falls in Division Nos.5 and 6 of Greater Warangal Municipal Corporation, Warangal. Learned Government Pleader states that the subject representation is still pending consideration. As the authority concerned is seized of the issue, this Court sees no purpose served in keeping this matter pending or inviting a counter-affidavit. It is for the authority concerned to consider the petitioner's representation in accordance with law and take appropriate action thereupon.
The writ petition is therefore disposed of directing the second respondent to consider the petitioner's representation dated 04.11.2015 in accordance with the relevant norms and take a decision in the matter. In the event the second respondent decides to reject the petitioner's representation, a reasoned order shall be passed in that regard and communicated to the petitioner. This entire exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
