THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12907 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioners who are arrayed as accused Nos.1 and 2 in FIR No.445 of 2025 of Vemulawada Town Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 109(1), 118(1), 352 r/w 3 (5) of BNS Act,2023.

The brief facts of the case are that, on 05.09.2025, the de-facto complainant lodged a report before the police stating that there are long-standing land disputes between the accused No.1 and the de-facto complainant and on the date of incident, accused No.1 called the de-facto complainant to settle the disputes and on repeated request of the accused No.1, on 05.09.2025, he went there, wherein accused Nos.1 to 4 were present and immediately, they attacked him, his brother and his friend with sticks, title stones and with granite stones and all the injures persons sustained grievous injuries. Hence, he requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri P. Prabhakar Reddy, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that, in fact, the petitioners sustained injuries in the hands of the defacto complainant and the de-facto complainant and other injured persons sustained simple injuries. It is further submitted that the petitioners are in jail from 05.09.2025 and the material part of the investigation was already completed. It is further submitted that the petitioners also lodged a report before the police against the de-facto complainant and others and the same was registered. Therefore, he prayed the Court to grant bail to them by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against them are serious in nature. It is further submitted that they are the habitual offenders and there are other cases pending against these petitioners, 4 cases are pending against accused No.1 and 8 cases are pending against accused No.2. As such, if they are released on bail, they will commit the same offences.

Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are in jail from 05.09.2025 and the medical certificate produced by the learned Additional Public Prosecutor shows that they sustained grievous injuries. Further, as seen from the record, there are 4 cases are pending against accused No.1 and 8 cases are pending against accused No.2. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions. i.

The petitioners/ accused Nos.1 and 2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate Vemulawada, Rajanna Sricilla District.

ii.

The petitioners/ accused Nos.1 and 2 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners/ accused Nos.1 and 2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
