The present Writ Petition came to be filed with the following prayer:- "...to issue Writ, Order or Direction more particularly in the matter of Writ of Mandamus, declaring the action of the respondents in not taking any action against the Deputy Commissioner-2 Division, Sales Tax, Vijayawada Range pursuant to complaint dt.27.04.2016 given by the petitioner is illegal, arbitrary and against the principles of natural justice and consequently direct the respondents to take action against the Deputy Commissioner, Sales Tax, Vijayawada Range in the interest of justice and consequently direct the respondents to punish the Deputy Commissioner-2 Division, Sales Tax, Vijayawada Range namely Seethalam Sekhar and pass...

When the matter is taken up, Sri Y.Neelakanta Reddy, learned counsel appearing for Sri P.Udaya Bhaskara Rao, Special Public Prosecutor for ACB Cases (Andhra Pradesh) states that a case in crime No.09/RCACIU/2016 was registered on 15.06.2016 and the same is under investigation. In view of the fact that a crime has already been registered, nothing survives for adjudication in this Writ Petition.

3. The Writ Petition is accordingly dismissed as in fructuous. Pending miscellaneous petitions in the Writ Petition shall stand closed. No order as to costs. ________________________
