THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12917 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking his enlargement on bail in connection with Crime No.1080 of 2025 of Vanasthalipuram Police Station, Rachakonda. The offences alleged against the petitioner are under Sections 74 of Bharatiya Nyaya Sanhita, 2023 and under Section 7 r/w.8 of Protection of Children from Sexual Offences Act, 2012.

The case of the prosecution is that the defacto complainant lodged a report before police on 01.08.2025 stating that on 30.07.2025 the complainant gave Rs.100/- to her daughter who is aged about 6 years to bring milk packets from the Kirana shop situated in their colony. The daughter of the complainant returned home and gave remaining money with purchased two milk packets and her daughter seem to be scared and when she asked her about what happened, she revealed that after giving milk packet the uncle of kirana shop caught hold her hand and dragged her inside by touching her

- 2 - chest and behaved indecently. He also tried to touch her private part, she shouted loudly, as such, he left her daughter. As such, the complainant requested the police to take necessary action against the accused. Basing on the said complaint the police registered the case against the accused for the said offences.

Heard Sri G.Venkat Ramana, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. The allegations are totally false and the petitioner is in jail from 11.08.2025, material part of investigation is already completed and charge sheet is also filed. As such, requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the allegations against the petitioner are heinous in nature, though charge sheet is filed, petitioner is not entitled for bail and requested this Court to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, the petitioner herein in is in jail from 11.08.2025 and that investigation is already completed and charge sheet is also filed. Considering the period of incarceration of petitioner in jail, this Court is inclined to grant bail to the petitioner subject to the following conditions : i.

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of VII Additional Metropolitan Magistrate, Cyberabad at Hayathnagar.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
