THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 11824 OF 2023 ORDER:
This Criminal Petition is filed seeking regular bail to the petitioner/Accused No.1 in connection with Crime No.597 of 2023 on the file of Jagadgirigutta Police Station, Medchal-Malkajgiri District, for the offences punishable under Section 20(b) (ii) (C) of the NDPS Act. 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
The case of the prosecution is that the petitioner and another were found in possession of 1460 grams of liquid ganja. Accordingly, petitioner was remanded to judicial custody.

Learned counsel appearing for the petitioner would submit that though seizure was effected on 29.07.2023 itself, till date sampling had not taken place.

Learned Additional Public Prosecutor would submit that the inventory was acknowledged and sampling was done on 16.09.2023. 6.
There is a delay of nearly 47 days in depositing the contraband before the concerned Court and sampling. The sampling and certification of the inventory has to be done immediately. There is a delay of nearly 47 days. The said procedure adopted is in violation of the circular orders.

Accordingly, this Criminal Petition is allowed granting the petitioner the relief of regular bail on the following conditions. i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, among which one is local surety and the other is native surety, to the satisfaction of I Additional District and Sessions Judge-cum-Metropolitan Sessions Judge, Medchal Malkajgiri District at Malkajgiri. (ii) The petitioner/Accused No.1 shall appear before the concerned Station House Officer, on every Monday and Wednesday between 10.30 A.M. to 1.00 P.M. for a period of four weeks or until filing of charge sheet, whichever is earlier, for the purpose of investigation and thereafter, as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
Consequently, miscellaneous applications, pending if any, shall stand closed.
